FAQs regarding Copyright

Why are ÖNORMEN copyrighted?
ÖNORMEN are protected products by way of copyright law and by the regulatory law (Normengesetz) of 1971.

Who is in charge of the ÖNORMEN copyright?
The Austrian Institute of Standardization (referred to as ON from here onwards) is a neutral platform for the creation of ÖNORMEN and regulations and adopts its designated rights for exclusive usage and execution, according to the regulatory law (Normengesetz) of 1971. 

What documents are affected by copyright?

  • All printed and e-documents which are offered by Austrian Standards plus and ON (except legal texts)
  • Standards, especially ÖNORMEN of all appearances, pre-standards (ÖNORM/ÖVE, -EN, -EN ISO,...) and corresponding concepts
  • The same is true for withdrawn and invalid standards
  • Supplemental sheets for ÖNORMEN.
  • Other miscellaneous standardization products

What is duplication?
Any use of an ÖNORM (e.g. transcription, copying, printing, scanning, data transfer, etc.) trough which an additional exemplar is created, in a directly or indirectly noticeable form.

§ 42 (in German) of the Copyright law regulates a document's duplication when used privately.

I want to copy a standard for my private use – what do I have to consider?
Making several copies of excerpts of an original text is equal to duplication and requires permission. This is to obtain at: AS+ (Austrian Standards plus GmbH, A-1020 Vienna, Heinestraße 38, E-Mail: publishing(at)as-plus.at) 

What has to be considered when processing digital data?
A document is "duplicated” under copyright, when

  • the entire original of a text/ content of a document (text, statistics, graphs, pictures),
  • parts of the original text, beyond quotation, or an excerpt of minimally changed original text
  • is used in an electronic network or for data processing.

Publication on the Internet is prohibited.

What happens when the copyright is not adhered to?

Every unauthorized duplication constitutes an infringement, results in financial compensation and is liable to prosecution according to § 91 copyright law and § 8 regulatory law (Normengesetz) of 1971.
